Driver Charged to court over cheating
A commercial driver, Stanley Agera, was on Monday arraigned before an Abuja Magistrate Court for alleged criminal breach of trust and cheating, offences punishable under Sections 322 of the Penal Code.
Prosecutor Simon Ibrahim told the court that on October 3, one Regina Chukwuma of Lugbe Zone 5 reported at Utako Police Station that she gave the accused her Nissan Sunny car for commercial purposes on an agreement to be remitting N12, 000 weekly.
He said the accused who resides at Kado Kuchi village has for the past seven weeks failed to honor the agreement and converted a total of N84, 000 to his personal use.
“During police investigations, the sum of N4, 000 was recovered from the accused person” the prosecutor stated.
When the one count charge was read to the accused, he denied it and sought for bail, which was not opposed to by the prosecutor.
Magistrate Idayat Akanni granted the accused bail to the sum of N50, 000 with a surety in like sum, who must reside within the court s jurisdiction.
The case was adjourned to October 20 for hearing.
In another case, one Mallam Yahaya Adamu was brought to court for alleged criminal trespass, which is contrary to Section 348 of the Penal Code.
Prosecutor Danjuma Garba told the court that the accused trespassed into a community land with Plot No BD/02, BD/03 and RD/04, situated at Dutse Alhaji.
He said the Sarki of the community, Abubakar Bako, told the police that the accused did not only claim the plot of land belonging to the community but also sold part of it.
The accused denied the charge and said he paid for the plot of land with elders of the community being present.
He listed the late Sarki Noma of the community and the Madaki as well as other youths as his witnesses, adding that the problem started when the community confronted him to allow them turn the plot into a cemetery with a refund of N 16, 000 which he refused under threats.
The accused persons counsel, Barrister A.A. Muhammad then applied for Locus-Inco to enable the court see the structures and the plot of land mentioned in the case.
Chief Magistrate Adbullazeez Anka granted the lawyers request and fixed the visit for 11 am next week Friday.
The case was adjourned to October 15 for hearing.
